A Florida milk labeling case will proceed. On Monday, a U.S. District Court Judge rejected a motion by lawyers for Florida Ag Commissioner Adam Putnam to dismiss a suit brought by Ocheesee Creamery.
The creamery filed the suit last November after the State said it could not label its skim milk as “milk”. Under Florida law, all milk must contain the same amount of Vitamin A as whole milk. Most of the Vitamin A is in the cream so when the milk is skimmed, processors need to add it back in. Ocheesee Creamery owner Mary Lou Wesselhoeft says her customers don’t want milk with additives.
The Florida Department of Agriculture says without the proper Vitamin A level, it must be labeled: “Non-Grade A Milk product, natural milk vitamins removed.” Wesselhoeft refuses to label it that way saying it violates her First Amendment right to free speech.
The Tallahassee Democrat says the creamery hasn’t sold any skim milk since October of 2012.
